Terms of Service

1. Acceptance

These Terms of Service ("Terms") govern your use of Yomigo AI (the "Service"), operated by TachiTech LLC, a Connecticut limited liability company doing business as Yomigo AI ("we", "us"). By creating an account or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of a company, you represent that you have authority to bind that company.

2. The Service

Yomigo AI provides AI-powered voice agents for inbound and outbound telephony. You may configure agents, purchase or import phone numbers, ingest knowledge sources, and integrate with third-party tools. Voice runtime, telephony, billing, and analytics are subject to the limits of your subscription plan.

3. Accounts & workspaces

You are responsible for safeguarding access to your account and for all activity under it. Workspace owners may invite members and assign roles. You must provide accurate registration information and keep it current.

4. Subscriptions & billing

Paid plans are billed in advance via Stripe. Plan limits (minutes, agents, workspaces, phone numbers, team members) are enforced. Overage minutes are billed at the per-minute rate published on the Plans page when overage is enabled. You may cancel at any time; cancellations take effect at the end of the current billing period and we do not pro-rate refunds for partial periods unless required by law.

5. Acceptable use

You may not use the Service to:

  • Place or facilitate calls in violation of TCPA, TSR, GDPR, CCPA, or any applicable telecommunications, marketing, or privacy law.
  • Impersonate a person or entity, or misrepresent your affiliation.
  • Initiate calls to numbers on do-not-call registries you do not have lawful consent to contact.
  • Send spam, phishing, fraud, or scam content.
  • Reverse-engineer, scrape, or attempt to extract underlying models or training data.
  • Resell the Service or use it to build a competing voice-agent platform.

6. Calls, recordings & consent

You are solely responsible for obtaining the legally required consent of every party to a call, including consent to record, in every jurisdiction where the call originates or terminates. Yomigo provides a configurable recording-consent line and HIPAA-mode controls; using them is your obligation, not ours.

6a. HIPAA and Protected Health Information

You may not transmit, store, or process Protected Health Information ("PHI") as defined under HIPAA through the Service unless ALL of the following are true:

  • Your workspace is on a Custom plan;
  • You have executed a Business Associate Agreement (BAA) with Yomigo;
  • HIPAA workspace mode is enabled on your workspace;
  • You operate as a Covered Entity or Business Associate under HIPAA.

You are solely responsible for determining whether your workflow involves PHI and for designing your agent's behavior accordingly. Yomigo's PHI redaction control is a defense-in-depth safeguard; it does not relieve you of any HIPAA obligation. If you transmit PHI without satisfying the conditions above, you do so in breach of these Terms and at your own risk, and you indemnify us against resulting claims.

7. Customer data & confidentiality

You retain all rights to data you submit ("Customer Data"). You grant us a limited license to process Customer Data solely to provide the Service. We will not sell Customer Data and will only disclose it as required by law or as described in our Privacy Policy.

8. Third-party services

The Service depends on third-party providers (including Twilio, LiveKit, Cartesia, Deepgram, Google Cloud, and Stripe — the current list is published on our Sub-processors page). Their availability and pricing changes are outside our control. Your use of integrations (Salesforce, HubSpot, etc.) is governed by their own terms.

9. Warranties & disclaimers

The Service is provided "as is" and "as available". We disclaim all warranties to the maximum extent permitted by law, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to the Service shall not exceed the amount you paid us in the twelve months preceding the claim. We will not be liable for indirect, consequential, special, or punitive damages, or for lost profits or revenue.

11. Termination

You may close your account at any time. We may suspend or terminate your access for breach of these Terms, non-payment, or risk to the Service or other users. On termination, your right to use the Service ends immediately. Sections that should survive (including 7, 9, 10, and 12) will survive.

12. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Disputes will be resolved exclusively in the state or federal courts located in Delaware.

13. Changes

We may update these Terms from time to time. Material changes will be communicated via email or in-app notice at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
